
The ombudsman institution in Ukraine is envisaged in the Ukrainian Constitution and its organization was set down in detail in the Law on the Ukrainian Parliament Commissioner for Human Rights of 1997.
The Commissioner is appointed and dismissed by the Ukrainian Parliament (Verkhovna Rada) with the majority of all deputies. Proposals for candidates to the post of Representative may be made by the Chairman of the Ukrainian Parliament and by no fewer national deputies of Ukraine than one fourth of the constitutional composition of Verkhovna Rada of Ukraine. The Commissioner is appointed for the period of five years and is entitled to another tenure.
Claims relating to judicial activities fall outside the Commissioner's scope of competence. The Commissioner has the right to attend the sessions of the Parliament, the Cabinet of Ministers, the Constitutional Court, the Supreme Court and the higher specialized courts, the collegiums of procurators' offices of Ukraine and other collegiate bodies.
The Commissioner may appeal to the Constitutional Court of Ukraine with regard to the issue of conformity between the Constitution and the laws and the official interpretation of the Constitution.
The Ukrainian Ombudsman is assisted by a Secretariat. A board of advisors, made up of persons having practical experience in the area of protection of human and citizens' rights and freedoms, can be formed under the Commissioner with the aim of offering consultation, conducting scientific investigations as well as examining proposals on how to improve the situation with regard to the protection of human and citizens' rights and freedoms.
Financing for the activities of the Commissioner are allocated from the State Budget of Ukraine and he submits a financial report to the Parliament.
